Affidavit of Ownership

APPLICANT HEREBY AGREES TO ABIDE BY ALL OF THE LAWS, RULES, REGULATIONS, ORDINANCES, RESOLUTIONS, POLICIES, AND PROCEDURES OF THE DESERT WATER AGENCY AS THEY NOW EXIST OR MAY BE AMENDED.

APPLICANT FURTHER AGREES THAT THE OWNER OF THE LOT OR DEVELOPMENT SHALL BE RESPONSIBLE TO PAY ALL FEES, TAXES, ASSESSMENTS AND OTHER CHARGES ASSESSED, IMPOSED OR CHARGED BY DESERT WATER AGENCY UPON AND TO SAID LOT OR DEVELOPMENT FOR WATER SUPPLIES AND WATER SERVICE PROVIDED TO SUCH LOT OR DEVELOPMENT BY THE AGENCY, THE FAILURE OF WHICH WILL RENDER SUCH LOT OR DEVELOPMENT SUBJECT TO TERMINATION OF WATER SERVICE.

WATER METER AND RELATED APPURTENANCES, INCLUDING THE METER BOX, ARE THE PROPERTY OF THE AGENCY. ANY CONCRETE, LANDSCAPE, HARDSCAPE. OR RELATED SURROUNDINGS INCLUDING BUT NOT LIMITED TO SIDEWALK, DRIVEWAY, CURB, PAVEMENT, OR OTHER IMPROVEMENTS ARE THE RESPONSIBILITY OF THE PROPERTY OWNER. THE PROPERTY OWNER ACKNOWLEDGES CRACKING, SETTLEMENT, UPLIFT, DISPLACEMENT, OR OTHER DAMAGE TO THE SIDEWALK NECESSITATING REPAIR OR IMPROVEMENTS ARE ALSO THE RESPONSIBILITY OF THE PROPERTY OWNER. THE PROPERTY OWNER RELEASES AND AGREES TO HOLD HARMLESS AND INDEMNIFY DESERT WATER AGENCY FROM ANY AND ALL CLAIMS, DAMAGES, LIABILITY, OR EXPENSES ARISING FROM OR RELATED TO SUCH CONCRETE, LANDSCAPE, HARDSCAPE, OR SURROUNDING IMPROVEMENTS, INCLUDING BUT NOT LIMITED TO CLAIMS FOR TRIP-AND-FALL OR OTHER PERSONAL INJURY. UPON TRANSFER OF THE LAND TO ANOTHER PARTY, THE OWNER SHALL PROVIDE THE SUCCESOR IN INTEREST WITH A COPY OF THIS AGREEMENT.

Desert Water Agency Ordinance No. 70

9-1 Establishing Credit: Water service, in all cases, will be kept in the name of the property owner. Each applicant for water service will be required to establish credit to the satisfaction of the Agency before service will be rendered. Owner’s credit will be deemed established, with no deposit required, if the new owner can provide proof of ownership for the residential property to be serviced, and/or the owner has had previous service within the Agency service area during the past two years and maintained an account history where service has not been discontinued for nonpayment for 12 consecutive months. All non-residential service will require a deposit, unless the owner has other non-residential service with the Agency and has maintained an account history where service has not been discontinued for nonpayment for 12 consecutive months.

Desert Water Agency Resolution No. 1332 Section 24

16. Establishment fee charge: An administrative charge for Agency services to establish account in the new owner’s name shall be $30.00 per account.
